Service Content
YouBike is a public bicycle rental service provided by YouBike Co., Ltd. (hereinafter “the Company”), under authorization by the government authority of the county or city in which stations are located. The service is an automated “rent at Location A, return at Location B” system (hereinafter “the Service”). Besides the public bicycle rental service in the area where the Member has registered, the Member may also use the Service in other areas with YouBike-approved compatible systems.
Article 1. Definitions
- Member: A person who has completed the registration procedure via the YouBike oAicial website, a service center, a kiosk (self-service machine), the oAicial App, etc
- Rental (of a bicycle): When a Member uses a designated electronic stored-value card or mobile payment method to rent a public bicycle at a docking station where the Company provides the Service.
- Return: When a Member returns a public bicycle to a docking station supported by the Company, and completes the payment (deduction) using the designated electronic stored-value card or mobile payment.
- Single Rental User (Temporary Member): A person who is not registered as a Member, but uses the Service for a one-time rental and return of a public bicycle.
- YouBike 2.0: The version of YouBike public bicycles with white and yellow body coloring.
- YouBike 2.0E: The version of YouBike public e-assist (electric-assisted) bicycles with white and orange body coloring.
- Bicycle: Refers to any one or all of YouBike 2.0 or YouBike 2.0E.
Article 2. Personal Data Regulation
- Categories of Personal Data Collected
In accordance with the Personal Data Protection Act, the types of personal data that Members provide to the Company for use of the Service include: name; National ID Card number or ARC (residence certificate) number or passport number; date of birth; mobile phone number; email address; address; credit card number; electronic stored-value card number or mobile payment account information. - Purposes of Collection of Personal Data
Under the enumerated purposes in the Personal Data Protection Act, the Member’s personal data will be used for: (001) personal insurance; (040) marketing business; (063) collection, processing and use of personal data by non-governmental institutions as defined by law; (069) matters concerning contracts, quasi-contracts or other legal relations; (090) consumer/customer management and services; (135) information (communications) services; (136) information (communications) and database management; (137) information security and management; (157) survey, statistics and research analysis; (181) other operations consistent with the business registration items or articles of incorporation. - Period of Use of Personal Data
The personal data may be used during: (a) the duration of the specific purposes; and (b) as long as required by relevant laws or necessary for the Company’s operations, whichever is longer. - Territory of Personal Data Use
Within the Republic of China (Taiwan). - Recipients of Personal Data & Methods of Use
- The Member’s personal data may be used, within the scope of the collection purposes, by the Company, government authorities, and other entities assisting in operation, maintenance, or policy implementation of the public bicycle system.
- The Company may, in accordance with the respective county/city government policies and regulations, use the registration data to enroll Members in public bicycle injury insurance on their behalf.
- Methods: via automated machines or other non-automated means.
- Rights of Inquiry, Access, Copying, Correction, Suspension, Deletion
Under Article 3 of the Personal Data Protection Act, a Member may request from the Company:- to inquire or request access to their personal data;
- to obtain a copy of their personal data;
- to supplement or correct their personal data;
- to request cessation of collection, use or processing of their personal data;
- to request deletion of their personal data.
- To do so, the Member must submit a signed application at a Company service center and pay any required administrative fees.
- EAect of Not Providing Personal Data
Members are free to choose whether to provide the required personal data; however, refusal to do so will make registration as a Member impossible, and the associated services cannot be provided.
Article 3. Use of Electronic Stored-Value Cards & Mobile Payment
After registration for the Service, the Member is responsible for maintaining the confidentiality and security of the designated electronic stored-value card or mobile payment account, and agrees to:
- Not acquire electronic stored-value card numbers or mobile payment account identifiers by theft, impersonation, or other improper means.
- Immediately notify the Company if the electronic stored-value card or mobile payment account is stolen or there is any other security breach.
Article 4. Protection of Children and Minors
If a Member falls under persons lacking full capacity, limited capacity, or under a guardianship/assist arrangement under Civil Law, then the Member shall use the Service only after their legal representative or assister has read, understood, and agreed to all terms herein. By using the Service, it is presumed that the legal representative or assister has read, understood, and agreed to be bound by this contract.
Article 5. Use of the Service and Riding Precautions
- Upon completing registration, becoming a Member grants Qualification to use the Service; the Company does not guarantee that a bicycle will always be available to rent or that there will always be a docking space to return. Any damage or loss caused by this is not the responsibility of the Company. If a Member wishes to end a ride but no docking bay is available to return, the Member may use the “full-station extra-time” function via the App as provided, receiving free additional time to return to a nearby station or wait at that station.
- The valid term of membership starts from the date the registration is completed, and lasts until the occurrence of any of the events specified in Article 7, or until the Service is terminated by government order.
- Bicycles provided under this Service are suitable only for persons with height between 140 cm and 190 cm; persons outside that height range may not rent. The Company assumes no liability for damage arising from non-compliance.
- Members shall not use the Service for any illegal purpose or method; must obey relevant laws of the Republic of China and customary rules of road use; ride with respect for others’ legal rights; in particular, follow these principles:
- Ensure one's own safety: if the Member’s mental or physical state is not adequate for safe riding, the Member should not rent or should cease riding.
- Comply with the “Regulations for Slow Moving Vehicles” in the Road TraAic Management Penalty Act (Chapter on slow vehicles), and the rules for slow vehicles under the Road TraAic Safety Regulations.
- Obey traAic signs, lane markings, signals, and directions from law enforcement oAicers.
- Avoid entering fast vehicle lanes; do not cross roads in prohibited sections.
- Remain alert to road and environmental conditions; maintain a safe riding distance.
- When braking: brake the rear wheel first (i.e. right hand brake), slow down, then brake the front wheel (left hand brake); avoid emergency braking to maintain comfort and safety.
- In conditions of poor visibility, slippery surfaces, or riding uphill/downhill, slow down or dismount and walk Bicycle if necessary.
- Do not compete for priority, ride abreast in a way that blocks others, race, orride dangerously.
- When overtaking, do so only where the bicycle lane permits passing the vehicle ahead on the left, then return to your lane.
- Members shall not use the Service in ways that infringe upon others’ rights, violate law, or for profit; shall comply with fair-use of rentals; shall not monopolize or hold Bicycle for extended periods in a speculative manner, causing inconvenience to others.
- The Service is unmanned; before renting, the Member should check via the oAicial website, App, or station display whether Bicycle is in proper working condition. If there is any abnormality, do not rent. If Bicycle becomes faulty within five minutes after rental, return it immediately to the original station; no rental fee will be charged. If the original station is full and cannot accept return, contact customer service for assistance.
- If a Member accidentally loses a bicycle during the rental period, unless unable to report the loss to the police, the Member shall as soon as possible file a report with the nearest police authority; provide the police report certificate to the Company; and pay the rental fee from the start of rental until the time of loss (as indicated in the police certificate). The rental relationship terminates at that time. If the bicycle is lost for reasons attributable to the Member or a third party under Article 10.3, and is not recovered within three months after loss, the Member shall pay compensation to the Company: for a YouBike 2.0 bicycle: NT$15,000; for a YouBike 2.0E bicycle: NT$25,000. If the bicycle is later found and returned to the Company, the Company will refund to the Member the excess of the compensation already paid, after deducting necessary maintenance and repair costs, without interest.
- Members must pay rental fees by means of electronic stored-value card or mobile payment. The Member must use a registered card or payment account to rent. One card or payment account may rent only one bicycle at a time; simultaneous rentals on the same card/account are not permitted.
- Single Rental Users (Temporary Members) shall follow procedures for rental and return of Bicycle as directed in the oAicial App.
- Bicycle shall be ridden only singly (one person), not carrying passengers; nooverloading or modifications; and shall not carry:
- prohibited items;
- dangerous goods;
- items unclean or likely to soil or damage Bicycle;
- animals unsuitable to be carried on Bicycle;
- items that aAect the safety of riding.
- Except with prior written consent of the Company, Members shall not use Bicycle or rental station equipment for commercial or non-commercial purposes such as marketing, advertising, promotion, filming, product display, etc.
- During rental, the Member is responsible for all traAic violation fines or penalties; if the Company pays or performs on behalf of the Member, Member shall indemnify the Company. If Bicycle is towed, the Member shall bear related storage fees, fines, and other charges.
- If an accident involving bodily injury, death or property damage to the Member or third-parties occurs while riding, unless unable to report to police, the Member shall immediately file a police report and notify the Company; the rental relationship terminates. If the accident is attributable to the Member, the Member shall bear legal liability and compensation. If Bicycle is damaged due to reasons attributable to the Member, the Member shall compensate.
- If an accident occurs during use of the Service, Member shall immediately notify law enforcement and the Company, take photos for evidence, move Bicycle (if possible) to avoid blocking traAic or further accidents. If injury or fatality, call 119. The costs of rescue, repairs, rental fees during repair period, and all damages to third parties shall be borne by the Member.
- The Member shall exercise due care as a prudent manager in keeping possession of Bicycle; shall not sell, pledge, pawn, nor repair it. The ownership remains with the Company. If Bicycle is lost, the Company may seek and publicize recovery; ownership remains with the Company even if recovered.
- The Company has insurance in place under the following coverages; unless otherwise agreed by government authority, the amounts are as follows. Publicbicycle liability insurance and public bicycle injury insurance may be insured on behalf of Members depending on policy rules of relevant governments:
- Product liability: USD 5,000,000.
- Public accident liability: NT$24,000,000.
- Public bicycle liability insurance: per person bodily injury or death maximum NT$2,000,000.
- Public bicycle injury insurance: per accident for disability or death up to NT$1,000,000; daily hospitalization allowance NT$1,000.
Article 6. Payment Deduction Method & Rates
The methods for deducting payment, the rates charged, and policies regarding cross county/city renting and returning are as published on the Company’s oAicial website (https://www.youbike.com.tw/).
Article 7. Change, Termination, Suspension or Interruption of Service
- The Company reserves the right to change the content of the Service in accordance with law or by order of government authorities.
- Members must at all times ensure the correctness and completeness of their personal data. If data registered is false, incomplete or incorrect, any resulting damage or disadvantage (including but not limited to the protection under public bicycle injury insurance) shall be borne by the Member; the Company may also suspend or terminate all or part of the Member’s right to use the Service.
- If a Member violates the laws of the Republic of China or these Terms, the Company may immediately terminate or suspend the Member’s right to use the Service; if the Company suAers damage as a result, the Member shall be liable for compensation.
- Upon receiving notification from the Member, the Member’s agent, or trustee, or upon order of a government authority, or in accordance with applicable laws and regulations, or where the Member has outstanding payments or has not rented Bicycle for more than two consecutive years, the Company may suspend or terminate the Member’s account privileges and delete all related account information and transaction records.
- ember agrees that the Company may collect, process, and use violation records (such as demerit points) supplied by county/city government authorities in relation to public bicycle violations, and impose limits on a Member’s use of the Service.
- If a Member is in any of the following circumstances, the Company may suspend the Member’s right to use the Service; the Company shall determine case by case what conditions must be satisfied for reinstatement:
- Riding after consuming alcohol, riding while drinking, or dangerous driving.
- Damaging or soiling Bicycle or the related equipment.
- Using Bicycle for criminal acts.
- Obtaining Bicycle by improper means.
- Using Bicycle or related facilities for risky behavior that may endanger persons or property.
- Improper custody of carried items or malicious disposal of items which cause damage to the Company.
- mproper behavior toward Company personnel or conduct that may aAect operation or management.
- Violation of prohibitions under these Member Terms.
- Other situations in which rights or interests of the Company or third parties are endangered.
- Member shall not assign or transfer the membership qualification to any third party.
Article 8. Advertisements
The Company shall not be liable for any compensation for the content of all advertisements, descriptive texts, images, sample displays, or other sales information viewed by Members in the Service, except in instances where the Company knows or should reasonably know that the advertisement contains false information but still publishes it.
Article 9. Intellectual Property Rights
- All hardware, software, or programs used by the Company, and all content on the website, including but not limited to writings, images, files, information,data, website structure, web page layouts, and design are the intellectual property of the Company or other rights holders under law, including but not limited to trademark, patent, copyright, trade secrets, and proprietary technology. No one may use, modify, reproduce, publicly broadcast, publicly transmit, adapt, distribute, publish, conduct reverse engineering, decompile, or disassemble them without authorization.
- If a Member wishes to quote or reproduce content as set forth above, the Member must obtain prior written consent from the Company or appropriate rights holder. If violated, the Member shall be liable for damages.
- Names, designs, presentations, etc. relating to the Service’s associated goods or services (the “YouBike Trademarks”), as registered or used by the Company, are protected under the Trademark Act, Fair Trade Act, and other relevant laws. No person may use the YouBike Trademarks for profit-making purposes without prior written permission of the Company.
Article 10. Contractual EAect
- By using the Service, the Member is deemed to have read, understood, and agreed to all terms of this contract.
- For Members who are not of full legal capacity, usage is only permitted after legal representative or guardian has read, understood, and agreed to all terms; the foregoing applies similarly.
- If a Member lends or transfers the registered electronic stored-value card or mobile payment account, or the bicycles provided by the Service, to a third party, the Member must guarantee that the third party is aware of, and agrees to be bound by, the contents of this contract, and the Member and the third party shall be jointly and severally liable for obligations arising under this contract.
- The rights and obligations in this contract apply mutatis mutandis to Single Rental Users (Temporary Members), except for the rules specifically relating to use of registered electronic stored-value cards/mobile payment (which may diAer).
Article 11. Amendments, Additions, Termination of Contract
f there are any additions, modifications, or termination of this contract, the Company shall announce them on the oAicial Service website and/or the App, or notify Members by other appropriate means.
Article 12. Governing Law and Jurisdiction
- The interpretation and application of this contract, and any disputes arising from or related to this contract, shall be governed by the laws of the Republic of China (Taiwan). The Taipei District Court shall be the court of first instance.
- The Company’s failure to exercise or enforce any right or provision under this contract does not constitute waiver of such right or provision. If any provision of this contract is adjudicated by a competent court to be invalid, the remaining provisions shall continue in full force and eAect.
